After choosing an available house, please, contact us and we will send you a reservation form. Within five days of making a reservation you should pay a deposit of 2 000 euro. The reservation fee will be deducted from the price of your house.
In 45 days we will agree together on a payment plan according to your personal financial ability and we will sign a preliminary contract.

Management and maintenance of residential area Terres

Management
Management and maintenance of the residential area will be accomplished by Maison Creative or its newly created affiliated company for this purpose. During the first two years, and namely 2008 and 2009, the owners of the plots are not paying any expenses for gardening service, cleaning and maintenance of Terres. After this period they will be obliged to pay an annual tax for maintenance of the residential area, calculated on the basis of expenses planned for the coming year. Maison Creative Ltd is obliged to give detailed information at the general meeting of the residents in Terres about the planned expenses for the current year. The expenses mentioned above will be calculated for each owner in Terres proportionally to the size of the owned plot.

Legislation
Acquiring the property rights upon Bulgarian legislation is settled in the Constitution of Republic of Bulgaria and in some parts of Civil Law concerning property, state property and municipal property. Under article 22 of the constitution there is very important decree on acquisition the ownership of land rights. According to the above mentioned decree it is disallowed ownership of land rights to be gained by aliens or alien legal entity and this is the reason for the presence of some specificity in acquiring the property on the territory of Bulgaria by aliens.
A variant which gives the opportunity the prohibition of the constitution to be avoided by lawful means is a legal entity to be established by an alien – a sole limited liability company. After such registration in a respective Bulgarian court, the alien becomes a Bulgarian legal entity and therefore there are no more legal obstacles to purchase either a building or land. As the owner of the legal entity and its manager you rule over the assets and the real estate purchased will also be considered as assets. After the abrogation of the prohibition of the constitution the company can sell everything to its owner and can be closed. There is no obstacle for the company to continue existing even it will be more appropriate if you have plans for business relevant to the real estate bought.
We can assist you with the registration of the company by preparing all necessary documentation, accompanying you to the bank where a new bank account will be opened and after that registering the firm in the court.
There is another peculiarity; the acquiring of the ownership of a real estate becomes possible only if a notarial deal is made namely concluding an agreement in the presence of notary in a special form of Title deed. The form is ensuring the legality of the deal namely acquiring of the property on notarial manner. This is a compulsory condition for raising the effect of the deal. Moreover, in case of buying the immovable, examinations on a special register upon courts will be made. Such examinations verify whether the applicant who presents himself as an owner is an owner indeed and also whether the property is mortgaged in favor of a third party. Tax assessment is given by the tax authorities and the tax payable for acquiring the property is defined on the basis of such assessment.
The purchase of a real estate practically includes two stages – signing a preliminary agreement and subsequently issuing a Title Deed after the final deal. The preliminary agreement specifies the property which will be bought, the duties of the constructor-seller and duties of the purchaser. It determines the terms for construction as well as the quality requirements and prices.
On the final selling the Title Deed is set up where all elements individualizing your property are specified – area, location, borders, neighboring properties, value.
